SC orders CBI probe into false criminal cases filed against Bengal BJP leader Bose

New Delhi, Dec 4 (UNI) The Supreme Court on Wednesday ordered CBI investigation into two assault and sexual harassment cases arising from an incident on December 6, 2020, against West Bengal Bharatiya Janata Party (BJP) leader Kabir Shankar Bose.
A bench comprising Justice BV Nagarathna and Justice Pankaj Mithal delivered the judgement on a writ petition filed by Bose, who alleged that false criminal charges were levelled against him due to political rivalry.
"For all the above reasons and in the peculiar facts of this case, a writ of mandamus is issued to the respondents to hand over the investigation papers according to the two FIRs to the CBI along with all records for its completion, so that, if necessary, the trial may commence, and justice is done to the parties. The writ petition is allowed accordingly," pronounced Justice Mithal.
Bose has alleged that the cases were orchestrated by TMC MP Kalyan Banerjee, his ex-father-in-law. He claimed that on December 6, 2020, he was unlawfully restrained from leaving his house despite having protection from the Central Industrial Security Force (CISF) and was subsequently attacked. He further alleged that false criminal cases were filed against him due to a political vendetta.
The cases, registered at Serampore Police Station under multiple sections of the Indian Penal Code (IPC), including Sections 341, 323, 325, 326, 307, 354, 504, 506, and 34, were stayed by the Supreme Court on January 13, 2021. The court's decision followed submissions by the CISF in a sealed cover report, which included a copy of Bose's movement logbook.
On December 18, 2020, the Supreme Court directed the CISF to submit a special incident report, which the bench also received in a sealed cover.
Advocate Surjendu Sankar Das appeared for Bose, arguing that the charges were fabricated and politically motivated.
